Signify Prevails in U.S. Patent Trial, Reinforcing Value of EnabLED Licensing Program

In addition to finding infringement and rejecting the defendants’ invalidity challenges, the jury determined the royalty rates associated with the infringement of each asserted patent:

• U.S. Patent No. 7,014,336 – 5.0%

• U.S. Patent No. 7,348,604 – 6.0%

• U.S. Patent No. RE 49,320 – 6.5%

• U.S. Patent No. 8,063,577 – 1.0%

• U.S. Patent Nos. 7,038,399 and 7,352,138 – 3.4%

Notably, the jury determined damages independently for each patent, meaning products that infringed multiple patents were liable for damages on each.  And the jury found that each patent was willfully infringed.

The Court will address additional matters in post-trial proceedings, including the enhancement of damages (treble damages) in light of the jury’s finding of willful infringement, as well as pre- and post-judgment interest (up to 8.75% interest compounded quarterly), costs, post-judgment damages and attorney’s fees.  Following the Court’s post-trial determinations, the resulting damages award could increase significantly from the original jury award.

The patents asserted at trial, and many others, are available for license through the EnabLED licensing program. The program provides lighting companies with a transparent and efficient pathway to obtain rights to technologies that are broadly implemented in LED lighting products.

More than 1,700 companies worldwide have already joined the program, reflecting a shared commitment across the lighting industry to respect intellectual property while bringing innovative products to market.
